1. Definitions

InstaInfluencer.ai is a digital content creation platform that enables Users to generate videos using artificial intelligence based on User-provided inputs (such as text).

1.2 User

A User is any person or legal entity that accesses the Platform, creates an account, and uses the services provided by InstaInfluencer.ai.

1.3 Generated Content

Generated Content refers to all videos, images, or other digital media that are created using InstaInfluencer.ai's artificial intelligence based on the User's input. This includes AI-generated influencer videos or promotional materials created through the platform.

1.4 Personal Space

A Personal Space refers to the User's private account on the Platform, where they can store and manage content, initiate video generation, and access paid services.

1.5 API

An API (Application Programming Interface) refers to the set of tools InstaInfluencer.ai may provide to allow third-party platforms to interact with its services.

1.6 Services

Services include all functionalities available on the InstaInfluencer.ai platform, including content generation, text-to-video services, and any associated features such as email notifications or tutorials. These services are available either for free or for a fee, depending on the subscription or payment model.

1.7 Credits

Credits refer to the digital currency used on the Platform, which Users must purchase to access certain paid features.

2. Acceptance and Modification of the GTC

By accessing and using InstaInfluencer.ai, Users agree to these GTC. The Company reserves the right to modify or update these terms at any time, with prior notice provided through email or when the User logs into their Personal Space. Continued use of the Platform after changes are posted implies acceptance of the new GTC. If a User disagrees with the modifications, they may terminate their account.

3. Object

The purpose of these GTC is to define the terms and conditions under which Users may access and use the Services provided by InstaInfluencer.ai. The Platform allows Users to generate AI-powered videos for promotional purposes. The Company provides a seamless, accessible tool for creating media tailored to the User's specifications based on input prompts. InstaInfluencer.ai operates solely in English at present and primarily offers services to Users who submit text input to generate AI-created media.

4. Description of Services

4.1 General Access

The InstaInfluencer.ai platform's public pages are accessible to any visitor. These pages include general information about the Company, tutorials, and descriptions of available services.

4.2 Account Creation

To access full services, Users must create an account by providing valid identification details such as their Google login credentials. InstaInfluencer.ai does not allow the uploading of custom images or videos at this time, limiting input to text prompts.

4.3 Content Generation

Upon account creation, Users can access the Platform to generate videos by providing specific text prompts describing what they want the video to depict. Videos are created using AI based on these descriptions and may include generic AI avatars or voice-overs generated by ElevenLabs.

4.4 Free and Paid Features

InstaInfluencer.ai offers both free and paid services. Users can generate content within the limits of free usage; however, to access more advanced features or generate more complex videos, Users must purchase credits via the platform. Credits are purchased through third-party payment provider Stripe.

4.5 Limitations

InstaInfluencer.ai's current limitations prevent Users from uploading their own images or videos. All generated content must be initiated through the text input system.

4.6 API Access

InstaInfluencer.ai may offer API services to allow other platforms to interact with its AI. Use of the API must adhere to all provisions outlined in these GTC.

5. User Obligations

5.1 Legal Use of the Platform

The User agrees to use the Platform in compliance with all applicable laws and regulations. Users are responsible for all content they input into the Platform and for ensuring that Generated Content does not violate any legal provisions, including but not limited to intellectual property rights, defamation, or offensive content.

5.2 Accurate Information

When registering on the Platform, Users agree to provide accurate, truthful, and complete information. InstaInfluencer.ai is not responsible for any issues arising from the submission of false or incomplete information.

5.3 Responsibility for Generated Content

The User acknowledges that they are solely responsible for reviewing the Generated Content to ensure that it aligns with their expectations and legal obligations. The User must ensure that the content does not violate third-party rights or any laws.

6. Financial Terms

6.1 Pricing

InstaInfluencer.ai offers free access to basic services, while additional services require the purchase of credits. The cost of credits will be clearly displayed on the Platform before any purchase is confirmed.

6.2 Payments

Payments for credits are processed through Stripe. InstaInfluencer.ai is not responsible for any issues that arise from Stripe's payment processing systems. The Price of services may change, and Users are responsible for ensuring sufficient funds are available for the purchase of credits.

6.3 Refunds and Cancellation

All payments made for credits or services are non-refundable unless required by applicable laws. Users can cancel services by contacting support, but this does not guarantee a refund.

7. Intellectual Property

7.1 InstaInfluencer.ai Content

All intellectual property on the Platform, including software, design, and media (excluding Generated Content), remains the exclusive property of InstaInfluencer.ai. Users are granted a non-exclusive license to use the platform to create and download Generated Content, but may not copy, modify, or distribute any other parts of the platform without express permission.

7.2 User Content

Users retain ownership of the text they input into the system, but grant InstaInfluencer.ai a license to use this text to generate videos or other media on their behalf.

7.3 Generated Content

Users own the Generated Content created through their input, with the right to use, share, or distribute this content freely. InstaInfluencer.ai makes no claim to ownership over Generated Content but is not liable for any third-party claims that may arise from the use of such content.

8. Liability

8.1 Limitations of Liability

InstaInfluencer.ai provides its services "as is" and does not guarantee that the Generated Content will meet the User's expectations. The Company is not responsible for any inaccuracies, legal violations, or damages resulting from the Generated Content.

8.2 External Links and Third Parties

InstaInfluencer.ai may provide links to third-party sites (such as Stripe for payment processing). The Company is not responsible for the content or practices of third-party websites, nor any issues arising from interactions with those sites.

8.3 No Warranty

InstaInfluencer.ai does not guarantee uninterrupted access to the Platform or its Services and is not liable for any service disruptions caused by technical issues, maintenance, or other factors beyond its control.

8.4 User's Responsibility

The User is responsible for ensuring that they have the legal right to use the content they provide to InstaInfluencer.ai and must not use the Platform to create any content that infringes on third-party rights.

9. Termination

9.1 User-Initiated Termination

The User may terminate their account at any time by deleting their Personal Space. This action will result in the loss of access to any remaining credits or Generated Content stored on the Platform.

9.2 Company-Initiated Termination

InstaInfluencer.ai reserves the right to terminate or suspend a User's account if they violate these GTC or engage in illegal activities. Termination may also occur if the User is found to be using the Platform to create content that violates intellectual property laws or other legal provisions.

10. Privacy and Data Protection

10.1 Data Collection

InstaInfluencer.ai collects personal data such as the User's Google login information. By using the Platform, Users agree to the collection and processing of their data as outlined in the Privacy Policy.

10.2 Data Retention

The User's data will be stored as long as they remain active on the Platform. Upon termination of the account, the Company will delete personal data in accordance with its data retention policies and applicable laws.

11. Force Majeure

InstaInfluencer.ai is not liable for delays or failure to provide services caused by events outside of its control, such as natural disasters, technical failures, or government actions.

12. Governing Law

These GTC are governed by the laws of the United States. Any disputes arising from these terms will be resolved in the courts of the relevant jurisdiction.

13. Dispute Resolution

In the event of a dispute between the User and InstaInfluencer.ai, the Parties agree to first attempt to resolve the dispute amicably. If an amicable resolution cannot be reached, the dispute will be subject to the exclusive jurisdiction of the courts.
